Recently, we have been receiving very quick turn-around on many PERM Labor
Certifications. Some have been approved in as quickly as two to three weeks.
In the past, the quickest approvals were in the teaching profession,
however, some of our recent quick approvals have ranged the entire spectrum
from EB-2 Engineering Managers to EB-3 athletic coaches.
The Department of Labor's increased pace of PERM approval has been
accompanied by an increased rate of accurately evaluating PERM applications.
Computer and human errors have become rarer at DOL relating to PERM
applications. Inappropriate audits and Labor Certifications, which seem to
get "lost" in the system, are infrequent.
Other good PERM news relates to applicants who have a previously approved
PERM, but wish to file a new one with the same employer. Previously, DOL's
computers would automatically deny a Labor Certification for an employee if
it is with the same employer, and there was no way to withdraw the
previously approved labor certification. Now it may be possible to withdraw
the older Labor Certification, and submit a new one. This is particularly
valuable for employers who wish for their sponsored employee to have a
higher-level job than had been previously considered.
