H-1 employer settled legal action to collect unpaid wages

We have represented a client who sued her employer under California's famous 17200 unfair business practice action for failure to pay her wages stated in the H-1 petition and labor condition application. The unpaid salary and interests are close to six figures.

Our client started working for this company in 2001. The H-1 petition stated her annual salary would be $36,000. She only received about $1000 a month. Although her salary was later raised, but it never reached the promised salary stated in the H-1 petition and labor condition application.

Employer claimed that our client was not qualified to do the work and she worked part time. This case lasted for more than 18 months and was settled on the day of trial when defendants(both the company and its owner/president) realized that their unclean hand defense would not work for liability in unfair business practice lawsuit.

Our client was very pleased with the settlement and hope everyone in her situation will stand up to fight for his or her rights, under the immigration law and labor law.
