美国时间四月六日,北美新浪网专访移民律师王小禾,谈投资移民与特殊人才的新趋势。
王小禾表示,该律师楼做得比较多的案子有特殊人才移民,国家利益豁免,投资移民,移民法院。
他指出,大陆现在有钱,但是学校就业水平与毕业后就业机会不理想,因此有相当一部分想把孩子送出来,小孩必须上私立学校,若上私立中学,每年费用估计要五万美金,中学四年共二十万,大学四年也要二十万,加起来共四十万。这些人有这么多钱把孩子送出来,为何不乾脆做投资移民,一年左右就有结果。若办成功,小孩上可公立高中。投五十万做投资移民从长远来看是合算的,有绿卡后,将来也没有工作签证的问题,哪怕将来要回国,有绿卡还是有帮助。
他解释,投资移民有两种方式,第一是投资一百万美金,在乡村地区可以是五十万,直接要雇用十人在企业内,现在这种方式愈来愈少,因为雇用十人的要求。
第二种方式是用地区中心做投资移民。移民中心在全美批准了四十几家地区中心,实际上是私人企业,向移民局报告,我们要在这个地方做中心,移民局决定这地区是高失业率的地区,经济学家预估他们可以达到间接雇用十人,移民局救批准中心成立。中心成立后,就每个具体投资项目成立有限合伙公司,每个投资人成为有限合伙人,投资公司作为普通合伙人来监管公司,抽取一定费用,是是现在最常见的情况。
他补充道,如果你人在美国以外,找个在美国的可靠律师楼,获得的资讯会很多。现在的问题是,很多中国的移民顾问也在国内招揽这类案件,移民顾问没有受到专门的训练,为了招揽生意,做出不实际的许诺,得不到真实的资讯。有些广告说五十万买房子就可投资移民,而且不用坐移民监,这些根本是乱讲。另一个问题是,大陆的移民顾问可能跟某个投资公司有关係,找他们,他们会直接介绍的某个投资公司,而不是让你有很多家投资公司选择。
他阐述,投资移民拿到的绿卡后,要待在美国比待在中国久一点,通常拿到绿卡前一两年待在美国时间少一点,移民局不会刁难,但是两年之后若还是这样,移民局就会关注,但是没有一定公式计算,根据你在国外的原因是什么,是看得到期限的待以及家属在何处,跟美国的联繫有多少
他说,绿卡持有者若在国外待超过半年才回美国的,申请公民的时间就要重新起算 除非有特别好的理由,也许移民局会考虑以前的时间不会废掉,但是国外待超过一年,肯定过去时间会废掉。
至于特殊人才的绿卡申请,王律师指出,由于申请标準很高,虽然有配额限制,但是很少人达到申请资格所以少人申请,以致配额依然有剩。
他说,拿到硕士很难有资格申请特殊人才,大多数拿特殊人才的,都拿到博士学位 再加做几年工作,有文章发表。从大陆来做特殊人才的更多是演员,画家,运动员 武术人才,这些人没有学位要求,只要有作品发表。
谈到H-1工作签证持有者若被解雇,王小禾道,若能在十天之内提出新的H-1申请,移民局通常不会追究,超过十天,成为灰色地带,移民局看实际情况,通常不超过一个月,恢復上班,被接受情况比较大,但不能抱着侥倖心理。一旦被解雇,要试着恢復合法居留身份,可考虑申请学生签证,一般有H-1都有大学学历,要回学校通常需要唸硕士,但是硕士班申请不是那么快。
